1. Acceptance of Terms

By accessing or using the Selekt Audio platform (“Service”), including our sample library, marketplace, community challenges, and AI-powered audio analysis tools, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Selekt Audio.

2. Account Registration

To access certain features of the Service, you must create an account. When registering, you agree to the following:

You must be at least 13 years of age to create an account. If you are under 18, you must have parental or guardian consent.
You must provide accurate, current, and complete information during registration and keep your account information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify Selekt Audio immediately of any unauthorized use of your account.

3. Sample Library License

All samples in the Selekt Audio library are sourced from public domain recordings and Creative Commons licensed sources. This includes sound recordings published before 1926 in the United States, recordings released under Creative Commons Zero (CC0), and recordings released under Creative Commons Attribution (CC-BY) licenses. By accessing the sample library, you are granted a perpetual, non-exclusive, worldwide license to use these samples in your music productions, including commercial releases. For samples licensed under CC-BY, you are required to provide appropriate credit to the original artist as specified in your download certificate. Your download certificate for each sample states the exact license terms and any attribution requirements — you are responsible for complying with these terms.

Selekt Audio does not claim ownership of public domain content. The samples may be used in any genre, on any platform, and in any media format without royalty obligations or clearance fees. This license applies to samples downloaded or streamed through the Service. Multiple users may use the same sample — all licenses are non-exclusive.

Jurisdiction Notice. Public domain status is determined under United States copyright law. Copyright terms vary by country. If you are located outside the United States, you are responsible for verifying that a recording is in the public domain in your jurisdiction before commercial use. Selekt Audio does not guarantee public domain status in all territories.

Content Verification. Every sample added to the Selekt Audio library is screened against a database of over 150 million commercially released recordings using audio fingerprinting technology prior to inclusion. Samples that show any commercial distribution signals — including record label ownership, distributor affiliations, ISRC/UPC registration, or presence on streaming platforms — are rejected. While Selekt Audio takes reasonable measures to verify the public domain or Creative Commons status of all content, no automated system in the industry can guarantee 100% accuracy. This applies equally to all platforms, regardless of size. Selekt Audio does not guarantee that every sample is free from all possible copyright claims worldwide. By downloading or using any sample from the library, you acknowledge that you are solely responsible for independently verifying the copyright status and clearance of any recording before commercial use in your jurisdiction. Your download certificate documents the source, license type, and screening results at the time of issuance.

AI Analysis Accuracy. Metadata provided for each sample — including BPM, musical key, genre, mood, instrument classification, and section boundaries — is generated by automated AI analysis and may not be 100% accurate. This data is provided as a convenience and should be independently verified for critical or professional use cases.

Stem Separation. AI-generated stems (vocals, drums, bass, other) derived from public domain samples inherit the same public domain status as the source recording. Stems are provided for creative use and may contain artifacts inherent to the separation process.

Downloads. Downloads require a Selekt account. We track downloads on your library page so you can revisit anything you've grabbed. Paid subscriptions include an allowance of 50 downloads per calendar month. The allowance resets at the start of each month; unused downloads do not roll over, and the allowance is available only while your subscription is active. Subscriptions started before July 19, 2026 are not subject to this monthly allowance and retain unlimited downloads for as long as the subscription remains active and uninterrupted.

Machine-Learning & Dataset Use. The license granted above covers use of samples as source material in music, media, and audiovisual productions. It does not include: (a) use of samples, stems, or derived data — including embeddings, transcriptions, or other extracted metadata — to train, fine-tune, or evaluate machine-learning models; (b) compilation of samples into a dataset or corpus; or (c) systematic or bulk downloading of the catalog. These uses require a separate written Dataset License from Selekt Audio, regardless of the underlying copyright or public-domain status of the material. 4. User-Generated Content

You retain full ownership of any original content you create, including beats, compositions, and sample packs. By uploading content to the Selekt Audio marketplace or participating in community challenges, you grant Selekt Audio a non-exclusive, royalty-free license to display, distribute, and promote your content within the platform.

You represent and warrant that:

You own or have all necessary rights to the content you upload.
Your content does not infringe on the intellectual property rights of any third party.
You will not upload copyrighted material that you do not have authorization to distribute.

Selekt Audio reserves the right to remove any content that violates these Terms or applicable law.

5. Marketplace Terms

The Selekt Audio Marketplace allows Pro tier users to buy and sell beats, sample packs, and other audio content. The following terms apply to marketplace transactions:

Sellers set their own prices and define their own license terms for each listing. Selekt Audio does not determine pricing or license structure.
Selekt Audio charges a platform fee on each completed transaction. The current fee schedule is available on the pricing page.
Sellers warrant that they have full rights to sell the content they list and that their listings do not infringe any third-party rights.
Buyers receive a license to use purchased content as specified by the seller's listing terms. All sales are between the buyer and seller; Selekt Audio acts as a facilitator.
Listings built entirely from Selekt Audio library samples receive a “Verified Cleared” badge automatically. Listings using outside material require the seller to attest that all content is original or properly cleared.
All marketplace listings are reviewed before going live. Selekt Audio reserves the right to reject or remove listings that violate these Terms.

6. Challenge Submissions

Selekt Audio hosts community beat-making challenges where producers submit original works (“flips”) created using a designated source sample. By submitting to a challenge:

You retain ownership of your submission. You grant Selekt Audio a non-exclusive license to feature, promote, and display your submission on the platform, in marketing materials, and on social media.
Submissions must use the designated source sample and comply with any rules specified for that challenge.
Voting is open to authenticated users. Each user may vote once per submission. Vote manipulation (including use of multiple accounts) is prohibited and may result in disqualification and account suspension.
Winners are determined by community vote count at the time the challenge ends. Selekt Audio reserves the right to disqualify submissions that violate challenge rules.

7. Community Sample Submissions

Users may submit public domain recordings to expand the Selekt Audio library. By submitting a sample, you represent and warrant that the recording is in the public domain and free from copyright restrictions. All submissions are reviewed by Selekt Audio before being added to the library. Accepted submissions credit the contributor on their public profile.

8. Copyright & DMCA Policy

Selekt Audio respects the intellectual property rights of others. If you believe that content on the platform infringes your copyright, you may submit a DMCA takedown notice to dmca@selektaudio.com with the following information:

Identification of the copyrighted work you claim has been infringed.
Identification of the material on the platform that you claim is infringing, with enough detail for us to locate it.
Your contact information (name, address, phone number, email).
A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
Your physical or electronic signature.

Upon receipt of a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing material and notify the uploader. Repeat infringers will have their accounts terminated.

9. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

Using the Service for any illegal purpose or in violation of any applicable law or regulation.
Redistributing raw, unmodified samples from the Selekt Audio library as your own sample pack or sound library.
Using automated tools, bots, scrapers, or crawlers to access, extract, or download content from the Service.
Compiling, extracting, or using samples, stems, or derived data to train, fine-tune, or evaluate machine-learning models, or otherwise building a dataset or corpus, without a separate written Dataset License.
Abusing or excessively using processing features (such as stem separation, audio restoration, or noise removal) in a manner inconsistent with normal individual usage, including but not limited to scripted or automated requests, intentionally circumventing rate limits, or patterns of use designed to consume disproportionate platform resources.
Attempting to interfere with, compromise, or disrupt the Service or its infrastructure.
Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.
Harassing, abusing, or threatening other users of the platform.

10. Intellectual Property

The Selekt Audio brand, logo, user interface, design, and AI models are the intellectual property of Selekt Audio and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the platform's proprietary technology without prior written consent.

Public domain samples available through the Service are not claimed as Selekt Audio's intellectual property. Original content created by users remains the property of its respective creators, subject to the licenses granted in these Terms.

11. Payment & Billing

Subscriptions. Selekt is currently in Early Access, available at $5 per month or $50 per year. Your Early Access rate is locked for the life of your subscription — it will not increase for as long as your subscription remains active and uninterrupted. Subscriptions automatically renew at the end of each billing period unless you cancel. You may cancel online at any time through the subscription settings on your Gumroad receipt or in your Gumroad Library. Cancellation of a paid membership takes effect at the end of the current billing period, and you retain access until then.

Seven-Day Trial. Eligible customers may start a seven-day Early Access trial by providing a payment method through Gumroad. Merely opening checkout does not start a trial. The trial begins only after Gumroad confirms enrollment. You pay $0 at enrollment and receive 3 tool credits and 3 total catalog or quote downloads for the trial period. Unless you cancel through Gumroad before the exact trial deadline shown in your confirmation, Gumroad will automatically charge the payment method on file for the plan selected at checkout — currently $5 per month or $50 per year, plus any applicable tax — and the membership will continue to renew automatically until canceled. Canceling during the trial prevents the first membership charge; trial access ordinarily remains available through the original trial deadline.

Trial Eligibility. The trial is limited to one per eligible customer. We may use account, email, checkout, payment-status, and device-related signals to enforce eligibility and prevent duplicate or abusive trials. We may decline or hold a trial for review when those signals indicate prior use, duplication, or abuse. Contact support if you believe a trial was declined in error.

Trial-to-Paid Allowances. After a verified successful monthly payment, the account receives 15 tool credits for that billing period and up to 50 catalog or quote downloads per calendar month. After a verified successful annual payment, the account receives 180 tool credits for the annual period and up to 50 catalog or quote downloads per calendar month. The first paid allowance replaces any remaining trial allowance; separately purchased credit-pack balances are not replaced. Current allowances and tool prices are displayed in the Service and may be updated as permitted by these Terms.

Payment Processing. All payments — including subscriptions and marketplace transactions — are processed by third-party payment processors (such as Stripe, PayPal, and/or Gumroad). By making a purchase, you agree to the applicable payment processor's terms of service. Selekt Audio does not store your credit card number or full payment credentials. All payment information is handled directly by our payment processors. Gumroad currently handles Early Access trial enrollment, automatic subscription billing, cancellation, and payment retries. We receive limited transaction, subscription, and status information needed to link and administer your Selekt access.

Refund Policy. Due to the nature of digital content, all sales of downloadable samples, beats, and sample packs are final and non-refundable once the content has been downloaded or streamed. Membership fees, including the first charge after a trial, are non-refundable for partial billing periods. Exceptions may be made at Selekt Audio's sole discretion or as required by applicable law.

Marketplace Payouts. Sellers receive payouts for completed marketplace sales via the payment processor. Selekt Audio deducts the applicable platform fee before disbursement. Payouts are subject to minimum thresholds and processing schedules determined by the payment processor. Sellers are responsible for any applicable taxes on their earnings.

Failed Payments. If a subscription payment fails, we will not apply a paid allowance unless and until the payment is verified as successful. Gumroad may retry the payment under its terms. If payment cannot be collected, your Selekt account may be downgraded to the free tier and paid access may end.

Chargebacks. If a buyer initiates a chargeback or payment dispute for a marketplace purchase, Selekt Audio reserves the right to suspend the buyer's account pending resolution. Sellers may be required to provide evidence that the transaction was legitimate.

Currency. All prices on the platform are displayed and charged in United States Dollars (USD).

12. Processing Features & Usage Limits

Selekt Audio provides AI-powered audio processing features, including stem separation, noise removal, and audio restoration (collectively, “Processing Features”). These features use cloud-based GPU infrastructure that incurs per-use costs to Selekt Audio.

Credits and Usage Limits. Some Processing Features are free and others use the number of tool credits displayed before you submit a job. A credit is a usage unit, not stored cash and not redeemable for money. Credit balances, plan allowances, file limits, tool-specific limits, and protective rate limits may apply. These controls help prevent abuse, manage capacity, and preserve reliable access. Current prices and material limits are shown in the Service. We may adjust them under these Terms and will provide notice when required by law.

Processing Results. Results from Processing Features (such as separated stems and denoised audio) are stored temporarily and generally expire between 24 and 72 hours after processing, depending on the tool. The Service may show a more exact availability period for a particular result. You are responsible for downloading your results before they expire. Expired results cannot be recovered and must be reprocessed.

User-Uploaded Audio. Processing Features allow you to upload your own audio files for stem separation, noise removal, and other processing. By uploading audio to the Service, you represent and warrant that you have all necessary rights, licenses, or authorization to process the audio you submit. Selekt Audio provides audio processing tools for lawful use — similar to a digital audio workstation, audio editor, or format converter — and does not monitor, verify, or assume responsibility for the copyright status of user-uploaded files. You are solely responsible for ensuring that your use of uploaded audio complies with all applicable copyright laws and licensing agreements. Selekt Audio shall not be liable for any claims, damages, or legal actions arising from your upload or use of audio content that you do not have the right to process. User-uploaded files and their processed results are stored temporarily, are not made available to other users, and are automatically deleted after the expiration period.

No Guarantee of Availability. Processing Features depend on third-party GPU infrastructure that may experience downtime, capacity limitations, or service interruptions. Selekt Audio does not guarantee uninterrupted availability of Processing Features and shall not be liable for any failure or delay in processing.

13. Termination

Selekt Audio reserves the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that is harmful to the platform, other users, or third parties. Upon termination, your right to access the Service will cease immediately.

Abuse-Related Suspension. If we detect patterns of abusive usage — including but not limited to automated or bot-driven requests, repeated circumvention of rate limits, or usage volumes inconsistent with normal individual use — we may take the following actions at our sole discretion:

First occurrence: Temporary suspension of your account and a written warning sent to the email address on file. Access to processing features will be disabled during the suspension period.
Repeated violations: Permanent termination of your account. Selekt Audio may, at its sole discretion, issue a prorated refund for any unused portion of your current billing period. Refunds are not guaranteed for accounts terminated due to Terms of Service violations.

You may delete your account at any time through your account settings. Upon deletion, your profile and associated data will be removed in accordance with our Privacy Policy. Any content you have sold on the marketplace may remain available to buyers who have already purchased it. Deleting your Selekt account does not cancel a Gumroad trial or subscription. You must cancel it separately through your Gumroad receipt or Gumroad Library to prevent future charges. Account deletion removes access to unused Selekt credits and does not create a refund. Certain restricted billing, audit, and anti-abuse records may be retained as described in our Privacy Policy.

14. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Copyright Screening. Selekt Audio employs audio fingerprinting technology to screen every sample against a database of over 150 million commercially released recordings before inclusion in our library. This screening checks for record label ownership, distributor affiliations, ISRC/UPC registration, and presence on major streaming platforms. This screening uses ACRCloud acoustic recognition technology used across the music industry. However, no automated copyright detection system — regardless of the platform or company operating it — can guarantee 100% accuracy. Selekt Audio does not warrant or guarantee that any sample in the library is free from all possible copyright claims worldwide. Download certificates reflect the results of our screening process at the time of issuance and do not constitute legal advice. Users are solely responsible for independently verifying rights and clearance in their jurisdiction before any commercial use.

No Legal Advice. Nothing on this platform — including download certificates, license labels, source attributions, or screening results — constitutes legal advice or a legal opinion. If you require legal certainty about the copyright status of a recording, you should consult a qualified attorney in your jurisdiction.

Selekt Audio does not warrant that AI-powered audio analysis results, including BPM detection, key detection, instrument classification, or any other automated analysis, will be accurate, complete, or error-free. AI analysis is provided as a convenience and should be verified independently for critical use cases.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Selekt Audio and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Service, regardless of the theory of liability.

In no event shall Selekt Audio's total aggregate liability exceed the amount you have paid to Selekt Audio in the twelve (12) months preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.

16. Changes to Terms

Selekt Audio reserves the right to modify these Terms at any time. When changes are made, we will update the “Last updated” date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
